The following Grievance Procedure is designed to facilitate a smooth process for the resolution of such grievances as may arise between the Aggrieved Party(s) and the Respondent(s) here at MTI. The procedure has been designed to give students an opportunity to air their grievance(s) and to determine an appropriate redress where warranted. The prompt resolution of all grievances is the aim of the procedure.
INFORMAL PROCEDURE WITHIN THE INSTITUTE
Step 1. The Aggrieved Party(s) should try to speak with the Respondent directly to resolve the grievance.
Step 2. If the grievance is unresolved, the Aggrieved Party and the Respondent should select a third party to help to mediate in the dispute.
FORMAL PROCEDURE WITHIN THE INSTITUTE
1. If the Aggrieved Party(s) has/have not obtained satisfaction through the informal procedure explained above, then the Grievant may pursue the matter further by submitting a formal, written grievance statement to the Head of Department who shall forward the grievance to the Administrator. The grievance statement should state the name of the Aggrieved Party(s), the date and source of the grievance, the Respondent, the nature of the grievance, the evidence on which the grievance is based, the redress sought, and a description of steps already taken to settle the dispute.
2. The Administrator shall set a date and time for a formal hearing to be held within ten (10) working days by the Admissions and Academic Discipline Committee or within thirty (30) working days, in the case of an ad hoc Committee of the Academic Board after the grievance has been filed. The Grievant and the Respondent are entitled to nominate a representative each to be present at either hearing.
- The Administrator shall give copies of the formal, written grievance statement to the Respondent and to each member of the Committee and/or Sub Committee prior to any hearing.
- The Aggrieved Party(s) and/or the Respondent may lodge an appeal with the Administrator against a decision and within five (5) working days of the Institute’s Admissions and Academic Discipline Sub Committee’s decision, the Chief Executive Officer (or the Designate) must review any written record of the case. In the absence of such a request, the Chief Executive Officer (or Designate) may, within five (5) additional working days, conduct such a review. In either case, the Chief Executive Officer (or Designate) may confirm, amend, overturn or return the written decision and/or recommendations to the Committee for reconsideration and shall state in writing the reasons for this decision, and must report this decision to the Aggrieved Party(s), the Respondent, Admissions and Academic Discipline Sub Committee and the Administrator within five (5) working days of the review. The Above procedure will obtain unless the grievance is against the Chief Executive Officer in which case the procedure outlined below relating to such a case will apply.
- Should the Chief Executive Officer be the Respondent, the Administrator shall submit the formal, written grievance directly to a member of the Board of Directors so designated by general resolution or to the individual nominated by the Board to receive it. The Board will in such a case empanel a Sub Committee to deliberate and pronounce on the matter.
6. The Committee and or Sub Committee shall report its decision and justification for its findings with recommendations in writing to the Grievant and Respondent within five (5) working days after the conclusion of the formal hearing.
7. All decisions that recommend expulsion are subject to an appeal to a full sitting of the Board of Directors and the decision of the Board will be final. At any time, limits mentioned for the procedure may be extended with the mutual consent of the Grievant and the Respondent.
